TripGames Terms and Conditions

1. General provisions

These Terms and Conditions govern the use of the TripGames mobile application and related online services provided by MOSPAN sp. z o.o.. They set out the rules for electronic service delivery, the rights and obligations of users, and the responsibilities of the parties. These Terms form a template agreement and are made available in a form that allows users to store, reproduce and review them at https://tripgames-signaling-sqlite.przybjulv2.workers.dev/terms.

3. Scope of the service and technical requirements

The application is intended for entertainment and multiplayer gameplay, including local and online play. Features may include public and private lobbies, player profiles, deep links, premium access, advertising, chat, user-generated content and photo-based game mechanics. Certain features may process photo metadata, including location metadata embedded in a selected image, where needed for gameplay.

Using the application requires a compatible mobile device, a supported Android or iOS version, the current version of the application, and for online features a functioning internet connection and any required device permissions. The application is not a medical, emergency, financial or gambling service. Virtual points, rankings and similar in-app values are for entertainment only and do not represent monetary value.

4. Eligibility, profile data and security

By using the application, you represent that you have the legal capacity to enter into this agreement or, if you do not have full legal capacity, that you use the application with the consent and supervision of a parent or legal guardian where required by law. You are responsible for the lawfulness of your nickname, avatar, profile information and any content you upload, and for keeping your device and access credentials secure. You should use updated software and report security incidents without undue delay.

5. License and intellectual property

The application is licensed, not sold. MOSPAN sp. z o.o. grants you a limited, revocable, non-exclusive, non-transferable license to use the application solely on devices you lawfully control and only in accordance with its intended purpose. All rights, title and interest in the software, interface, databases, original content, branding, compilations and service infrastructure remain with MOSPAN sp. z o.o. or the relevant rights holders.

Except to the extent expressly permitted by mandatory law, you may not copy, modify, distribute, sell, lease, sublicense, decompile, reverse engineer, scrape, create derivative works from, remove technical protections from, or otherwise exploit the application or its assets outside the permitted scope of use.

6. Payments, premium access and subscriptions

Some features may be paid, including premium access sold as one-time purchases or recurring subscriptions. Before purchase, you should receive clear information about the price, billing period, automatic renewal, scope of premium access and how to cancel. Purchases may be processed through app stores, payment processors or other permitted billing channels made available in the checkout flow. The rules of those third parties may also apply.

If premium access is offered as a subscription, it renews automatically until cancelled before the end of the current billing period. Deleting the application does not cancel an active subscription. Refunds, chargebacks, failed payments and billing disputes are handled according to the rules of the relevant purchase channel and mandatory law. Any future change in price or other material paid-service terms will apply prospectively after clear notice and, where required by law or platform rules, after your express acceptance.

Virtual tokens, scores, rankings or other in-app values are not redeemable for money, goods or property rights unless mandatory law requires otherwise.

7. Consumer withdrawal rights and cancellation

If a paid digital service or digital content contract is concluded directly with MOSPAN sp. z o.o., consumers may have a statutory 14-day right of withdrawal unless a legal exception applies. Where the performance of digital content or a digital service begins before the expiry of that period at your express request and after proper notice of the loss of withdrawal rights, that right may expire to the extent allowed by law. For purchases made through app stores or third-party payment channels, the relevant store or provider procedures may also govern cancellations and refunds.

8. Acceptable use and prohibited conduct

You must use the application in compliance with applicable law, these Terms, public decency and the rights of others. In particular, you may not upload or transmit unlawful content; infringe copyrights, trademarks, image rights or personality rights; impersonate other persons; harass, threaten or discriminate against others; distribute spam, malicious code, sexual or violent content that is unlawful or prohibited by the service rules; scrape or systematically extract data; use bots, cheats, exploits or automation; circumvent security, premium gating or access controls; interfere with the operation of the service; or use the application for fraudulent, abusive or unauthorized commercial purposes.

9. User content, photos, chat and moderation

You remain responsible for all user-generated content you create, upload, send or otherwise make available through the application. By doing so, you represent that you have all rights, permissions and consents necessary to use that content, including where other people appear in a photo. To the extent necessary to operate the service, you grant MOSPAN sp. z o.o. a non-exclusive, worldwide, royalty-free license to host, store, display, transmit, technically adapt, moderate and review that content for service delivery, abuse prevention, legal compliance and enforcement of these Terms.

Reports of unlawful content, impersonation, rights violations, safety issues or abuse should be sent to mospan24@outlook.com. MOSPAN sp. z o.o. may remove, hide, restrict, disable access to, or suspend content, accounts or service access where there is a reasonable belief of a legal violation, a breach of these Terms, a security risk, or a risk to the rights of third parties. MOSPAN sp. z o.o. is not subject to a general obligation to monitor all user content in advance, but may take preventive and reactive moderation measures as permitted by law.

10. Availability, updates and changes

MOSPAN sp. z o.o. may provide updates, patches, technical improvements and feature changes, and may temporarily limit availability for maintenance, security, infrastructure failures, actions of third parties or force majeure events. You should install updates made available to you. To the extent permitted by law, MOSPAN sp. z o.o. may not be responsible for a lack of conformity that results solely from your failure to install an update that was properly made available and clearly communicated.

If a change materially and negatively affects a paid digital service or digital content, you will receive prior notice and any rights required by law, which may include the right to terminate, cancel or decline renewal under the new terms.

11. Complaints, support and statutory rights

Complaints about the operation of the application, access problems, technical defects, premium access errors, billing issues or the conformity of digital services may be sent to mospan24@outlook.com, unless the matter must be handled through the relevant app store or payment provider tools. A complaint should, where possible, include a description of the problem, the date it occurred, the user or device identifier, device model, operating system version, app version, purchase channel and the requested resolution.

MOSPAN sp. z o.o. will respond without undue delay and no later than within 14 calendar days unless mandatory law requires a different timeline. Nothing in these Terms limits non-waivable rights available to consumers under applicable law, including rights relating to the conformity of digital content and digital services.

12. Liability, privacy and final provisions

MOSPAN sp. z o.o. exercises reasonable care in operating the application but does not guarantee uninterrupted, error-free or risk-free availability. To the maximum extent permitted by law, liability towards users acting outside consumer protection regimes may be limited to direct and foreseeable losses, excluding lost profits and losses caused by other users, app stores, infrastructure providers or third parties. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer protections.

The Privacy Policy is available at https://tripgames-signaling-sqlite.przybjulv2.workers.dev/privacy. Acceptance of these Terms does not replace any consent required by law for marketing communications, device access permissions, cookies or advertising technologies. The agreement for free features is concluded for an indefinite period and may be terminated by the user at any time by ceasing to use the application and deleting it from the device, but that does not cancel an active paid subscription. MOSPAN sp. z o.o. may suspend or terminate access where required for legal compliance, security, the protection of third-party rights or enforcement of these Terms. These Terms are governed by Polish law, without prejudice to mandatory consumer protections that apply in the country of the consumer's habitual residence.
